SD gets money from settlement with Aventis

PIERRE, - South Dakota Attorney General Larry Long says the state will get more than $185,000 as part of a $95.5 million settlement with Aventis Pharmaceutical Inc. in what Long calls a drug-pricing scheme.

In a release, Long says the settlement resolves allegations that between 1995 and 2000, Aventis and its corporate predecessors knowingly misreported best prices for the steroid-based anti-inflammatory nasal sprays Azmacort, Nasacort and Nasacort AQ.

The attorney general says Aventis had agreements with a large health maintenance organization to avoid reporting the best price for the medications. Long says drug rebates to the Medicaid program and to several other federal health programs were underpaid.

State Medicaid programs will receive more than $40 million of the settlement.
