Stiefel sues KV Pharmaceutical over acne gel

Stiefel Laboratories Inc., a Florida-based dermatology company, sued KV Pharmaceutical Co. last week, alleging an infringement of a patent for Duac topical gel, an acne medication.

The lawsuit, filed Thursday, seeks to stop KV from manufacturing and selling a similar topical gel. KV had submitted a new drug application for the gel to the U.S. Food and Drug Administration, according to the lawsuit.

A Stiefel spokeswoman declined to comment on the lawsuit.

A request for comment from KV was not immediately returned.

Brentwood, Mo.-based KV has suspended drug shipments, halted all production and recalled painkillers because the tablets were oversized.

In March, KV said it entered into a consent decree with the FDA that outlines a series of measures that will permit KV and its subsidiaries to resume manufacturing and distribution.
